Obtaining Australian permanent residence is an important decision and can grant you access to certain privileges (e.g. medicare) and also obligations (e.g. tax). For those who are not eligible or do not seek Australian citizenship, it is important to know that despite allowing for an indefinite stay once in Australia, permanent visas have a travel facility (or re-entry rights) that lapse. In other words, the ability to travel overseas and return to Australia on that visa has an expiry date.
If the permanent visa’s travel facility is expiring or has expired, the permanent Resident Return (Subclass 155) visa (RRV) renews the travel facility.
What are the eligibility requirements for a RRV application?
Broadly speaking, to be eligible for a RRV you will need to demonstrate one of the following:
- you have been present in Australia for at least 2 years in the last 5 years; or
- if you have not been in Australia for at least 2 years in the last 5 years, demonstrate substantial ties of benefit to Australia, and depending on your immigration history, demonstrate compelling circumstances for any periods of absence.
